The complex reality of online gambling in Argentina: between legislation and prohibition

While Buenos Aires and Córdoba have advanced in the legalization and regulation of this activity, others such as Mendoza and Corrientes maintain a prohibitionist stance. In turn, the Autonomous City of Buenos Aires (CABA) has established a comprehensive regulatory framework under the supervision of the Buenos Aires City Lottery (LOTBA).
In Buenos Aires, online gambling was legalized in 2018 with Law 15,079, allowing companies to operate under strict licensing and control conditions. In turn, this law seeks to prohibit actions regarding services, advertising and promotion of any online game outside of said regulations. The regulation seeks to combat illegal gambling and generate significant tax revenue. Córdoba, for its part, has also developed a regulatory system that grants licenses to private operators under a regime of continuous supervision, ensuring compliance with safety and transparency standards.
On the contrary, in Mendoza and Corrientes, online gambling is still prohibited. Provincial authorities have expressed concerns about the potential associated risks, such as the increase in gambling addiction and the lack of effective mechanisms to prevent gambling among minors. This restrictive stance has generated criticism from those who see the regulation as an opportunity to control and channel activity in a way that is safe and beneficial for the local economy.
LOTBA
In CABA, the situation is different. LOTBA has implemented detailed regulations that include measures for the protection of players, the prevention of money laundering and the promotion of responsible gambling. Operators must meet rigorous technical and financial requirements to obtain and maintain their licenses. This meticulous regulation is presented as a model to follow for other jurisdictions seeking to balance the economic benefits of online gambling with the protection of citizens.
Additionally, LOTBA requires online casinos operating in Buenos Aires to comply with strict rules and regulations, including:
- Measures to prevent gambling addiction
- Protection of personal and financial information of players;
- Effective encryption protocols and security measures.
In conclusion, The disparity in online gambling regulation in Argentina highlights the need for a more harmonized approach at the national level. While some provinces move toward more permissive and controlled regulation, others remain reticent, creating a legislative patchwork that can be confusing for operators and players alike. The challenge lies in finding a balance that allows the development of the online gaming industry in a safe and responsible manner, benefiting the provinces and protecting citizens.
